These Terms of Use are a legally binding agreement between you as the user(s) of the Website (referred to as "you", "your" or "User") and the Company (referred to as "we", "us", "our" or "Company"). By accessing the Website or using the Services, you agree to be bound by these Terms of Use. The Company may amend these Terms of Use at any time by posting updated terms on the Website. Your continued use of the Services constitutes acceptance of the amended terms.
1. Eligibility
The Services are available only to persons who can enter into a legally binding contract under the Indian Contract Act, 1872. Minors (under 18 years of age) and persons incompetent to contract are not eligible to use the Website or avail the Services. By registering, you represent that all information provided by you is accurate, and you agree to indemnify the Company against any claim arising from incorrect information.
2. User Account and Registration
a. To place an order, you will be required to provide your contact information and email address, verified via a one-time password. You are responsible for maintaining the confidentiality of your account and all activities that occur under it.
b. You agree to make only legitimate orders. Speculative, false, or fraudulent orders are prohibited and may be cancelled and reported to relevant authorities.
c. Immediately notify the Company of any unauthorized use of your account. The Company may verify account information at its sole discretion and reserves the right to refuse access, terminate accounts, or remove content at any time without notice.
3. Contract of Sale
a. Listing of a product on the Website is an invitation to make an offer. Placing an order constitutes your offer to purchase.
b. An order confirmation email/SMS is merely an acknowledgement of receipt and does not constitute acceptance of your offer.
c. A contract of sale is concluded only when the product is dispatched and a shipping confirmation is sent to you. All orders are subject to product availability.
4. License
We grant you a limited, revocable licence to access and use the Website solely for purchasing products and processing returns and refunds. This licence does not include resale of products, commercial use, data mining, scraping, copying of login credentials, or creating derivative databases from Website content.
5. Pricing and Payment
a. All prices are subject to change without notice. The following payment methods are accepted: Credit/Debit Card, UPI, Digital Wallet, Net Banking, Gift Cards/Vouchers, and Credits.
b. Gift cards and credits are valid for 1 (one) year from issuance, are non-transferable, have no cash value, and cannot be used on discounted or sale items unless stated otherwise.
c. Other fees (if any) are non-refundable. Outbound shipping is free on all orders.
d. In case of a pricing error, we will notify you and offer the option to confirm at the correct price or cancel for a full refund.
e. Any credits used on an order will not be refunded upon cancellation or return of that order.
6. Communication
By using the Website, you consent to receive communications (SMS, email, WhatsApp, or other means) from us. You may opt out of marketing communications at any time via the unsubscribe option in our communications or by contacting support@athraah.com. Transactional communications related to orders, accounts, and returns are unaffected by opt-out.
7. User Responsibilities
You agree to: use the Website only for lawful purposes; provide accurate information; behave professionally with Company representatives; not interfere with the Services; not use Website data for commercial purposes; and not publicly share private support correspondence. You must be at least 18 years of age and have full legal capacity to accept these Terms.
8. User Conduct
You shall not copy, reproduce, or commercially exploit Website content; use data mining or scraping tools; frame or misuse the Website's trademarks; purchase for resale; introduce malware or conduct denial-of-service attacks; or use the Website for any unlawful, harmful, or fraudulent purpose. Any User Content you provide grants the Company a perpetual, royalty-free licence to use it in connection with operating the Website and Services.
9. Limitation of Liability
Your use of the Website is at your sole risk. To the fullest extent permitted by law, the Company disclaims all warranties and shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of the Website, inaccuracies in content, unauthorized access to servers, or interruption of service.
10. Intellectual Property
All intellectual property rights in the Website and its content belong to the Company or its licensors. You may not reproduce, distribute, or use any content without express written authorization. You retain ownership of User Content but grant the Company a licence to use it for operating the Website and Services.
11. Delivery and Shipping
a. All orders are subject to availability. We reserve the right to cancel orders and issue refunds if a product is unavailable.
b. Delivery will be attempted up to 3 (three) times. If all attempts fail, the order may be cancelled and shipping charges may be deducted from any refund.
c. If a delivered package appears damaged or tampered with, refuse to accept it, as acceptance may affect return or refund eligibility.
d. Risk in the products passes to you upon delivery. Ownership passes upon receipt of full payment.
12. Warranty and Returns
a. Returns and exchanges are accepted within 5 days of delivery, subject to the Return & Exchange Policy, which governs in the event of any inconsistency with this clause. A reverse shipping fee of INR 150 applies. Final sale items and sample units are not eligible for return.
b. Products must be returned in original packaging. Returns without original packaging or unauthorized inbound shipments will be discarded without notice.
c. Once the returned item is received and inspected at our warehouse, the refund is initiated within 5-7 business days to the original source of payment for prepaid orders.
d. For defects, email support@athraah.com within 5 days of delivery with your order details and photographs.
13. Cancellation
a. Orders can only be cancelled before being processed for packing or dispatch. Once shipped, cancellation is not possible.
b. Approved pre-dispatch cancellations and post-delivery returns are refunded via the original payment mode.
c. Initiating a chargeback or payment reversal without first contacting customer support constitutes a breach of these Terms and may result in account suspension and recovery of associated costs.
14. Force Majeure
The Company shall not be liable for any delay or failure in Services caused by circumstances beyond its reasonable control, including internet failures, equipment failures, natural disasters, pandemics, strikes, governmental actions, or third-party non-performance.

These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts at Pune. For complaints or queries, contact us at support@athraah.com or +91 9213427636. A minimum of 7 (seven) working days is required to respond.
If any provision of these Terms is found invalid, the remaining provisions continue in full force. The Company reserves the right to amend these Terms at any time. Continued use of the Website constitutes acceptance of the revised Terms.
